    How do the police decide if i was driving under the influence of marijuana?

    I was arrested for driving under the influence after being caught speeding. I failed a field sobriety test and they found two empty bags of marijuana (with nothign in it.) I didnt smoke that day, but i did the day prior and i submitted a urine test. Eventhough i wasnt driving under teh influence, when i go to court will they say i was?

    yes you failed the field sobriety test and the found the empty bags as evidence if your urine pops positive they will have enough evidence to charge and convict you your punishment will be up to the judge as well as the law around were you live good luck

    at least in germany a quick test is being made then a BLOOD test

    only the blood test is important in germany
    the short tests or urine tests have no weight infront of a court ..they only exist to see if a blood test is needed

    they just only could have proven it with a blood test...all other is no proof but we all know about US legal system..

    If you were caught speeding and failed a field sobriety test, then you were obviously under the influence of SOMETHING. That's the point. And I think you deserve everything you get just for being to lazy to throw out your baggies, not just once, but twice.

    i think so because if you failed the test and have 2 bags of empty marijuana in your car i think that is enough evidence. =(

    Not preforming the FSEs properly and having the THC metabolites will be enough to get you convicted...usually.

    Get a lawyer.

    They can say anything they want to say, but discrediting that "proof" will be a function of how good your lawyer is.

    IOW, don't settle for a public defender - half the time they are incompetent morons who will ultimately wash up as prosecutors (where loser end up).

    It is well-known that THC breakdown products take weeks to get out of one's body. It is also well-known that such tests are not a proof of impairment at the time the sample was taken.

    Another BIG thing in your favor is that you say the bags were "empty". How empty? Did you pick up any other trash that day? ;->

    You were driving tooo Slowly?
    A Blood test is the only way to PROVE intoxication period. Urine tests only show past usage and DO NOT prove INTOXICATION!
    Also it takes up to 4 hours for the human body too process THC out of the blood stream and into your urine. At which point you are no longer under the influance.

    Go to www.norml.org and look up the state to state laws.. See if your state has "drugged driving" laws enacted, if they do you're f*cked.

    The metabolites are detected in urine for far longer than it is in the blood..

    I have heard stories of people not smoking for 2 or 3 weeks and after having to submit to a test they are convicted for DUI/DWI on a scant few THC metabolites swimming around. Even though the intoxicating effects are LONG gone.
