Can a man sue a woman accusing him of fathering her child troubling his married life? What complaint in legal term can he sue her? Defamation, mistaken identity... or simple libel?
The man shouldn't have had sex with her. He can demand a DNA test
He should consult his attorney to determine what legal iptions would be best for him.
This is not something to handle without an attorney.
The man could sue for defamation of character. If the accusations are verbal, the suit would be for slander. If the accusations are written, then libel would be the cause of action. However, the man should note that TRUTH, also known as JUSTIFICATION, is an acceptable defence for slander. If a paternity test proves that he is the father, his lawsuit would fail.
Before launching a lawsuit, it would be advisable to have a paternity test done unless the man is positive that he did not have sexual intercourse with the woman and could not have impregnated her..
He could due for defamation of character. It won't save his marriage though. Too many women have shallow personalities and personally believe that any accusation, even false accusations, must have some truth to them. It's called guilty even if proved innocent.
