The United States and Taxes

Learn the truth and the truth will set you free. The everyday United States citizen does not understand the tax code. We could compare the system to the biblical account of David and Goliath, the citizen being David and the Internal Revenue Service being Goliath.The facts are confusing. Most Americans are frustrated, but it is like trying to discover the “hidden picture”(Batra 61).
The United States of America’s constitution requires all federal taxes to be either a “direct” or “indirect”. A “direct” tax is directly on you , your rights, or your property and is always apportioned. It is basically a property tax. It is on something you own. A “indirect” tax is a tax on a privileged activity, (such as distilling alcohol or corporate activity) and the tax can be passed on to the consumer indirectly. An “indirect” tax must be first imposed to be valid. It is basically a privilege tax, it is on something you do. If we look at two court cases Pollock vs Farmer’s Land and Trust it was forbidden to lay direct taxes without apportionments (Mann 139). Another case proved that direct taxes must bear immediately upon persons, possessions, and enjoyment of right. Indirect taxes are levied upon the happening of an event or an exchange (Dodge 88). The United States constitution requires all direct taxes to be apportioned. In Article one of the constitution it states the government’s intentions state income tax is not apportioned, it can only be classified as an indirect tax. The united states has ruled that the income tax is an indirect excise tax, imposed on privileged activity. The cases of Brushaber vs Union Pacific RailroadCo. and Flint vs Stone Tracy Co. (American Myth) are two Supreme Court cases that have never been overturned. Again from a legal encyclopedia it is recorded that the right to own property can only be taxed with a direct tax. Big brother is conducting, he has his symphony; but, is anyone out there listening?
There are many facts that United States citizens need to become aware of. The federal government especially the IRS, uses special terms in its rules and regulations in an attempt to confuse citizens. The term, “United States” means District of Columbia, Puerto Rico, Guam and the U.S Virgin Islands. The term “State” (capitalized) means one of those same places. However “state” (not capitalized) refers to one of the 50 states or another country (Willis 166). Our most important right in America is our right to contract. Once an individual signs any contract that individual is bind to do what that contract says. Basically the IRS sends us an invitation each year to pay taxes and we accept the invitation not knowing we have a choice. The problem is once you accept the invitation you are legally bind to attend. If you file a tax return basically you have agreed to pay taxes on your income and you are legally bind to do so.
Why do people go to jail for not paying taxes? The fact is they don’t. No one has ever gone to jail for not paying taxes. People have gone to jail for tax evasion. Tax evasion and not paying taxes are completely different. If you sign a tax return with the IRS you have agreed to pay taxes on your full income. If there is money that you made that you did not claim then you lied (evaded) to the government; therefore, you can be taken to jail. But if you just do not pay taxes there is nothing that can be done because you have not signed an agreement to do so. There is a group of sovereign citizens who have never filed a tax return therefore no action can be taken. Richard Stewart who is head of the American Rights Litigators advises parents to teach there kids to never sign a tax return. He also states there is form you can give to your employer which prohibits them form withholding taxes(46).
Income or earnings what are we being taxed on? Income means “profits and gains made through the sale or conversion of capital asset.” Earnings “is a wage paid for services rendered.” No one born in any of the 50 states is required to file any form for money earned from labor in the 50 states. The reason why we must make a distinction between the two is because the supreme law of our land the constitution states that we have the “right to labor in an unregulated occupation is a, fundamental right and not a taxable privilege.” This right has been held up in court on several occasions (Murdock v.s Pennsylvania and Butchers Union Co. vs. Crescent City Co.
Taxes in general have become an acceptable word for most Americans. We now just accept the fact that we are taxed on average 46 percent of our income. The 46 percent includes all taxes including sales tax. The reason why most people accept this fact is because they think our country is using the money to pay for services provided (schools, mail armed forces etc.). This could not be farther from the truth. Back when Ronald Reagan was in office he put together a group of leading economist called the Grace commission (Goodman 245). Their job was to research our economy and to find how much money it would take to run our country each year excluding deficit. They were also asked to find where our income tax money was being spent. One of their first findings was that our country could run with no income tax. The reason being is that the money we pay in income tax does not go to run our country in any form. The money we pay in income tax goes straight to the eleven world banks that we owe our national deficit to and this is a never ending cycle. Because, all of the money we pay in income tax only pays a portion of the interest accumulated each year; therefore, we will never be able to pay it off.
So were does the money come to run our country? It comes from trade importing and exporting goods with other nations. “A country must not depend on the taxation of it’s citizens but the ability to compete on a global market spectrum.” The federal government also has taxes on certain goods such as tobacco alcohol etc..
We are on the verge of losing the one thing that made us such a great nation “Freedom”. American citizens have forgotten that we must stand up for what is right. What is happening in our country stemmed from a lack of education. But we must stop depending on our government to educate us. Because our government does not want us to be able to think for ourselves. If most citizens knew that in the government’s eyes the money we earned meant nothing there would be a revolution tomorrow and there should be. I remember reading about a time when some educated brave men and women stood up for what was right and threw tea in an ocean and created the greatest nation ever known to man.
